Previously, those aged 55 and above, individuals with severe disabilities, or victims of wildfires and natural disasters could transfer their tax assessments to another home within the same county, of equal or lesser market value, enabling them to relocate without facing higher taxes. However, with the implementation of Proposition 19 starting from April 1, 2021, eligible homeowners can now transfer their tax assessments to any location within the state. Furthermore, this proposition allows for the transfer of assessments to more expensive homes, albeit with an upward adjustment.

Analyzing the Impact of Proposition 19 on Inherited Property Taxes

Proposition 19 in California introduces a significant change to the way parents or grandparents can transfer their primary residence to their children or grandchildren while avoiding a reset of the property's tax assessment to market value. However, it's important to note that this exemption from reassessment only applies when the property being transferred was the primary residence of the qualifying parent(s) or grandparent(s), and the child or grandchild continues to use it as their primary residence. To benefit from this exemption, homeowners must apply for a homeowners exemption within one year of the qualifying transfer. As of February 16, 2021, Proposition 19 eliminates the parent-to-child and grandparent-to-grandchild exemption when the inherited property is not used as the primary residence by the child or grandchild. Consequently, properties inherited but not used as primary residences are now subject to tax reassessment at market value and can no longer be transferred without undergoing this reassessment.

Consequently, December 2022 witnessed a record low in the number of closings, with only 1,137 recorded, accompanied by the lowest median sales price of the year at $1,085,000 for single-family homes. According to the latest data, mortgage applications have experienced a steady decline for three consecutive weeks. The increase in rates will likely discourage potential home buyers from entering the market, as it raises the cost of borrowing and makes homeownership less affordable. Consequently, we can anticipate a notable impact on the number of mortgage applications in the coming week.

The recent increase in mortgage rates will undoubtedly have an impact on the real estate market nationwide, including smaller markets. However, when it comes to Orange County, I predict that the market will largely continue business as usual. The demand for real estate in Orange County remains strong, as indicated by the median days on market for all properties being just 29, which is relatively low. Additionally, inventory levels remain low, suggesting a limited supply of available properties.

While the rise to 7% mortgage rates may deter some buyers, it is unlikely to significantly hamper the overall market in Orange County. The market's continued strength and limited inventory suggest that there will still be active buyers in the region, potentially mitigating the impact of higher rates. Consequently, it is reasonable to anticipate that the Orange County real estate market will remain resilient despite the increase in mortgage rates. As a real estate broker who has guided many families through the sale of inherited property in Orange County, I have seen firsthand how much easier the process becomes when you understand the steps ahead of time.

This guide is designed to walk you through the process clearly, so you can make informed decisions and protect both your family's interests and the financial value of the property you have inherited.

Step 1

Determine the Status of Your Parent's Estate

Most adult children know they will eventually inherit their parent's property, but far fewer understand the specific legal procedures that determine how and when they can sell it. Before you think about listing the home, you need to establish your legal right to do so. That begins with locating any wills, estate documents, or trust agreements.

Inheriting real estate in California typically happens through one of three routes. The first is probate, a court-supervised process that oversees the distribution of the entire estate, including the sale of real property. Probate can be a lengthy process, particularly when there is no will or when the estate is complex. The second route is a transfer on death deed, sometimes called a beneficiary deed, which allows property ownership to transfer immediately without going through probate. The validity and specifics of this instrument depend on state law. The third and generally smoothest route is a living trust, which bypasses probate entirely and allows for a cleaner, faster transfer of assets including the home.

Understanding Your Tax Situation: What Heirs in California Need to Know

The tax implications of selling an inherited home are among the most important and most misunderstood aspects of this process. Getting this right can mean the difference between keeping a significant portion of your inheritance and being surprised by a large tax bill.

The Stepped-Up Basis: One of the Most Valuable Tax Benefits in Real Estate

When you inherit a property, your cost basis for tax purposes is generally "stepped up" to the fair market value of the home on the date of your parent's death. This is one of the most powerful tax advantages available to heirs and it is frequently overlooked.

Here is what it means in practical terms. If your parents purchased their Orange County home for $300,000 in 1990 and it was worth $1,800,000 when they passed, your basis as the heir is $1,800,000, not $300,000. If you sell the home shortly after inheriting it for $1,850,000, your taxable gain is only $50,000, not $1,500,000. The stepped-up basis effectively wipes out the capital gains that accumulated during your parent's lifetime. This is a significant benefit and one of the strongest arguments for selling relatively soon after inheriting rather than holding the property for years and allowing new appreciation to accumulate above that stepped-up value.

Capital Gains After the Stepped-Up Basis

If you hold the inherited property and later sell it for more than the stepped-up basis, the gain above that amount is subject to federal capital gains tax and California state income tax. California does not have a preferential long-term capital gains rate, so gains are taxed as ordinary income, which can reach 13.3% at the top bracket. Combined with federal rates, the effective rate on large gains can be substantial. This is another reason to consult with a CPA who specializes in real estate before deciding how long to hold the property.

Estate Tax vs. Inheritance Tax

Estate tax is a federal tax assessed against the total value of your parent's estate before any proceeds are distributed to heirs. For 2026, the federal estate tax exemption is substantial, so most families will not owe federal estate tax. Step 2

Identify the Estate Executor and Notify Interested Parties

Inheriting a home does not automatically give every heir full decision-making authority over its sale. The executor or personal representative of the estate, named in the will or appointed by the court in the case of probate, is the individual legally responsible for managing and authorizing decisions about the property.

Early in the process, identify who holds that role. If there are multiple heirs, clarify the chain of authority so that decisions about the sale do not become contested later. The executor is also responsible for notifying the deceased's creditors and for settling any outstanding debts using estate proceeds. This is not optional. Creditors have legal claims that must be addressed before the remaining proceeds can be distributed to heirs. A title search on the property will surface any liens, judgments, or other encumbrances that need to be resolved before the home can be sold with clear title.

Step 3

Address Inheritance Disagreements Early

When multiple heirs are involved in the sale of an inherited property, disagreements are common. Decisions about how to prepare the home for sale, who will fund upfront expenses like repairs or staging, how proceeds will be split, what asking price to set, and whether to accept a particular offer can all become points of conflict, especially when grief is compounding the stress of the process.

The most effective approach is to surface these conversations early, before a buyer is involved and before deadlines create pressure. Agree on responsibilities and decision-making authority upfront. If reaching consensus is proving difficult, a professional mediator who specializes in estate disputes can be a worthwhile investment. Step 4

Hire an Experienced Real Estate Agent

If your parent's home will be empty while you prepare it for sale, contact the insurance provider immediately and ask about vacancy coverage or a vacant home policy. A break-in, water damage, or other incident at an unoccupied home without appropriate coverage can be a costly and frustrating complication in an already stressful process.

Step 7

Secure the Property

A vacant home is a target. Take reasonable steps to protect the property while it is unoccupied. Change the locks, secure all entry points, and remove or properly store any valuables remaining in the home. Arrange for mail to be forwarded or picked up regularly so the home does not appear abandoned. Orange County Housing Market May 15th, 2023

Welcome to this week's real estate market report.

In comparison to last year, when housing inventory experienced a steady 5% weekly climb, this year we find ourselves in a unique situation. The spring market has brought about an unexpected trend of stagnant or even decreasing inventory levels, which is quite uncommon.

For over a decade, the months of March through May have traditionally represented the pinnacle of new listings throughout the year. Back in 2008, Orange County had 4,847 new listings recorded in March. Two years later, in March 2010, the number remained impressively high at 4,751, and this trend persisted with the peak consistently surpassing 4,000 listings until 2019. However, March of 2023 witnessed a significant shift, with only 2,096 new listings, amounting to a mere 43% of the peak seen in the past 15 years.

Several factors contribute to this scarcity of new residential listings. Firstly, over 50% of homeowners in Orange County enjoy mortgage rates of 4% and below. Given the favorable interest rates, it becomes less appealing for these homeowners to sell their existing properties in order to acquire another home and incur a higher interest rate of over 6%.

Another significant reason contributing to the scarcity of new listings is the unprecedented appreciation that homeowners have experienced. The substantial increase in property values has transformed their homes into valuable assets, further disincentivizing them from selling and relinquishing the benefits of this remarkable appreciation.

And that is a motivating factor for the high buyer demand that we have seen. Buyers have recognized that they can comfortably afford mortgages, even with higher interest rates. Additionally, they anticipate future opportunities for refinancing, making homeownership more affordable in the long run.
